OVERVIEW
Fogeam acts as a neutral service provider for adult gaming content. We respect intellectual property rights and require our developers to do the same. As a platform, we do not monitor uploaded content for copyright compliance but provide a mechanism for rights holders to report infringements.FILING A DMCA NOTICE
2.1 Requirements: To report an infringement, a valid DMCA notice must include:- Your full legal name and physical address (for verification).
- Identification of the copyrighted work.
- The URL(s) of the infringing content on Fogeam.
- A statement that you have a "good faith belief" the use is unauthorized.
A signature (physical or electronic).
2.2 Anonymous Limitations: Since Fogeam prioritizes user anonymity, we do not possess physical addresses or identity documents of our users/developers. Our communication with them is limited to their registered email addresses.RECOURSE FOR RIGHTS HOLDERS
When a copyright claim is verified, the rights holder may choose one of the following:
3.1 Takedown Request: The content will be disabled and archived from public view.
3.2 Rightful Takeover: The rights holder may request to take full control of the existing game listing on Fogeam, assuming ownership of the product page under their own developer account.LIABILITY & EARNINGS
4.1 Developer Responsibility: The developer who uploaded the content bears full and exclusive legal responsibility for any copyright infringement.
4.2 Instant Withdrawals: Because Fogeam grants developers instant withdrawal rights for their earnings, Fogeam is unable to provide monetary refunds or clawbacks for sales made prior to a DMCA notice. Rights holders must seek financial damages directly from the infringing developer.ARCHIVING & LEGAL DISPUTES
5.1 Archival Policy: Games subject to a DMCA takedown are not immediately deleted from our servers. They are moved to a secure archive and disabled for new purchases/downloads.
5.2 Dispute Resolution: If a counter-notification is filed, the content remains archived until the legal dispute between the parties is resolved. Upon a final legal determination, Fogeam will either restore the content or transfer ownership to the rightful party.STRIKE SYSTEM
6.1 Enforcement: Fogeam employs a "three-strike" policy for copyright infringement.- 1st Strike: Warning and content archival.
- 2nd Strike: 30-day developer account suspension.
3rd Strike: Permanent developer ban.
6.2 Severe Violations: Intentional mass-piracy or distribution of illegal/prohibited content (as defined in our Terms of Service) results in an immediate and permanent account deletion, bypassing the strike system.PROCESSING TIMES
- Acknowledgment: Within 24 hours.
- Initial Review: 1 to 3 business days.
Content Removal/Action: Within 24 hours of confirmation.
